1. About these terms
These Terms of Service (“Terms”) are the agreement between you and esimple Pte Ltd (“esimple”, “we”, “us”), a company incorporated in Singapore with its registered office at 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore (068914). They govern your access to and use of our websites, applications, and travel-eSIM services (together, the “Service”).
By creating an account, purchasing a plan, installing an eSIM you received from us, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
2. What we provide
esimple is a reseller of mobile data eSIM plans intended for travelers. We aggregate connectivity from a range of network operators and resellers (each, a “Network Provider”) and deliver the resulting eSIM profile to you electronically. The underlying mobile network on which your eSIM operates at your destination is provided by the Network Provider, not by us.
We are not a mobile network operator. We do not operate radio infrastructure, allocate spectrum, or guarantee coverage in any specific location. We are responsible for delivering the eSIM profile you bought, for providing accurate plan information at the point of purchase, and for applying our refund policy fairly.
3. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to purchase a plan. If you are buying on behalf of someone else, you confirm that you have the authority to do so and accept these Terms on their behalf.
You may use the Service as a guest or with an account. Accounts are identified by your email address; access is by magic-link sign-in. You are responsible for keeping access to your email account secure. We are not liable for losses that result from someone else accessing your email and using the resulting sign-in link.
4. Pricing and payment
Prices are displayed in U.S. Dollars on our website at the time of purchase. Your bank or card issuer may apply foreign-exchange and cross-border fees that are outside our control. Payment is processed by Stripe; we do not store full card details on our systems.
We may change prices, add or remove plans, and change features at any time. Changes do not affect plans you have already purchased.
Where applicable taxes apply (for example, Singapore Goods and Services Tax), they will be calculated and shown before you complete a purchase or included in the displayed price.
5. Activation and use
After payment we email you a QR code and manual-install details (SM-DP+ address and activation code). Installation is performed by your device. Your device must be eSIM-compatible and not locked by another carrier — we cannot guarantee compatibility with every device or carrier configuration.
Plans are intended for personal use while traveling. Each eSIM profile is single-use: once activated against a specific device, it cannot be transferred. Keep your QR code private; anyone who installs it can use the data.
6. Plan validity and data
Plan validity is measured in days. The validity period begins when your eSIM first registers on a mobile network at your destination, not when you purchase or install it. You can buy ahead and install before you travel without burning days; the clock starts on first network connection.
Data allowances are measured in gigabytes or, for some plans, as unlimited subject to a fair-use threshold. Once a plan’s data allowance is consumed or its validity expires, the eSIM stops providing data. You can top up an active plan (where supported by the Network Provider) or buy a new plan.
Coverage, speeds, and 5G availability depend on the Network Provider and the local operator they roam through, not on us. We publish what we know about coverage on each plan’s page in good faith; conditions on the ground may differ.
7. Refunds and cancellations
Our Refund Policy sets out when an eSIM is refundable, when it is not, and how to request one. In short: unactivated eSIMs are refundable within 30 days; once an eSIM has registered on a network it is not refundable unless it fails to function due to a defect on our or the Network Provider’s side.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation in your country or your destination country.
- Resell, sub-license, or commercially redistribute eSIM profiles you purchased from us without our prior written consent.
- Use the Service in a way that interferes with other users, the underlying networks, or our systems (for example, traffic that constitutes a denial-of-service, spam, fraud, or large-scale automated scraping).
- Attempt to reverse-engineer, decompile, or extract source code from our applications, except to the extent that applicable law expressly permits despite this restriction.
- Use the Service for activities prohibited by your destination country, including any uses that violate local content, encryption, or VPN regulations.
We may suspend or terminate access to the Service if we reasonably believe you have breached these rules.
9. Intellectual property
The esimple name and wordmark, the Service’s design, content, software, and trademarks are owned by us or our licensors. Nothing in these Terms grants you any right or license to use them other than to use the Service as intended.
10. Third-party networks
Connectivity is delivered by Network Providers including but not limited to KeepGo, Maya Mobile, and RedTeaMobile, who in turn roam through local operators in your destination country. Use of our Service is also subject to those providers’ terms where they apply to you directly.
We do not control the technical performance of those networks (speed, latency, jitter, coverage), nor any restrictions a local operator may apply (for example, blocked services). Service interruptions caused by a Network Provider or local operator are not a breach of these Terms by us.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, or available at any particular location, time, or speed.
12. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the plan giving rise to the claim, or (b) one hundred U.S. Dollars (USD 100). We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenue, data, or business — even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be announced on the website and, where appropriate, emailed to account holders. Continued use of the Service after an update means you accept the updated Terms. The “Effective” date at the top of this page tells you when the current version took effect.
14. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. You and we agree to submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any competent court to protect intellectual property or confidential information.
